Stock clearance

Merchants planning to sell off their stocks must declare this to Montpellier town hall, using the current Cerfa form.

Documents required for stock liquidations:

  • The completed cerfa form n°14809*01
  • An extract from the kbis less than 3 months old;
  • A complete inventory of the goods involved in the liquidation:
    • The nature and precise name of the items (reference, size, brand) ;
    • The quantities ;
    • The usual unit selling price including VAT, before liquidation (reference price) ;
    • The average purchase price excluding VAT (products with a selling price of less than €5 can be described in homogeneous batches.)
  • Piece(s) justifying the reason for the request:
    • Final cessation of business : deed of sale or sales agreement for the business, termination of the commercial lease, cessation of the business, document certifying retirement;
    • Seasonal suspension of activity (maximum duration of liquidation sales of 15 days);
    • Change of activity;
    • Substantial change in operating conditions: works estimate validated and countersigned, relocation or transfer of premises, change in the company's legal form.
  • If the declaration is made by a proxy, provide a copy of the power of attorney;
  • Email and telephone number of the applicant.

The prior declaration must be sent by e-mail commerce@montpellier.fr or by registered letter with acknowledgement of receipt to the following address:

A liquidation carried out without a prior declaration is punishable by a fine of €15,000.

For your information, a clearance sale must be accompanied or preceded by advertising, whatever the medium, announcing the sale of the goods concerned. Advertising may only relate to items listed in the inventory supplied with the prior declaration.

In particular, it must indicate: the date of the declaration receipt issued by the town hall, the period of price reduction and the nature of the goods being liquidated.
